Criminal Record Expungement in New Jersey

If your records are expunged, all agencies must purge records of your arrest, conviction, and any deferred adjudication. Once expunged, offenses cannot be held against you in future criminal proceedings. These records will not show up in criminal background checks, and you will be able to legally state on job, loan, or college applications that you were not arrested or convicted for that crime.

• Eligible Offenses: Most misdemeanor crimes (disorderly persons offenses such as marijuana possession, simple assault, shoplifting, and underage drinking) are eligible for expungement five years after you have served the sentence, paid fines, and/or made restitution. Ordinance violations (petty offenses) can be cleared after two years.
• Ineligible Offenses: Most felony crimes (e.g., murder, robbery, drug crimes, and sex crimes) cannot be expunged. A few indictable offenses qualify for expungement after 10 years. A DUI cannot be sealed through expungement.
